JUDGMENT

[1]The Claimant’s claim is struck out under Rule 37 on the basis that it has not been actively pursued and/or that the proceedings have been conducted unreasonably.[2]All future listings for this matter, including the final hearing on 17 April 2023, are to be vacated.

REASONS

[3]There was a preliminary hearing on 7 October 2022 where no parties appeared. Following the hearing the Judge issued a strike out warning to the Claimant and Second Respondent, The First Respondent never having filed a Response.[4]Neither party made written representations or requested a hearing.[5]The matter was then listed for a preliminary hearing today to determine whether to strike out the claim. The parties were informed of this on 17 November 2022 and again yesterday when the link was sent out to join by CVP. Case Number: 2402559/2022 2402604/2022[6]The Claimant failed to attend and failed to provide written notice to the Tribunal as to why he could not attend the hearing.[7]The Tribunal finds that the Claimant is not actively pursuing the case and the Claim is accordingly struck out.[8]Having struck out the claim it is not necessary to deal with the strike out warning against the Second Respondent.
