Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim in accordance with rule 21 of the Rules of Procedure.[2]The respondent is ordered to pay the gross sum of £1,076.92 for failure to provide a written statement of employment particulars (this equates to two weeks’ salary; 2 x £538.46; £538.46 being the average weekly salary).[3]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £1,550.77 (£28,000 per annum divided by 52 weeks = £538.46, divided by 5 days = £107.69 x 14.4 days).[4]The hearing listed on 5th October 2022 is cancelled.
