JUDGMENT
[1]The respondent must pay the claimant the sum of £1,941.71 unpaid wages within 14 days of the date of this Judgment.REASONS
[1]The claimant was employed by the respondent as external installation designer between October 2023 and January 2024.[2]The respondent agreed in its response filed late on 31 July 2025 that it owed the claimant £1,941.71 in unpaid wages.[3]The respondent alleged there was a time limit issue in relation to the presentation of the claim, which is a jurisdictional issue.[4]There is no issue in relation to time limits. The response stated the date the wages should have been paid was 28 January 2024. Primary limitation was due to expire on 27 April 2024. The claimant presented his claim on 29 April 2024.[5]However the claimant went to ACAS on 12 March 2024 and the certificate was issued on 16 April 2024.The claimant therefore has the benefit of the “stop the clock” extension of time provisions giving him an extension of time of 35 days to 1 June 2024 to present his claim. The claim was therefore presented within the time limit.[6]Accordingly I am satisfied I can issue this Judgment pursuant to Rule 22 ET Rules of Procedure 2024 as the respondent did not contest it owes this sum for unpaid wages to the claimant.[7]The claimant’s claim for disability discrimination is not affected by this Judgment and will proceed to final hearing on 29 May 2026.
