The claims are struck out as an abuse of process, pursuant to rule 37(1)(a) of the 2013 rules of procedure.REASONS
[1]By a letter of the tribunal sent to the parties on 12 August 2019 the Tribunal gave the claimant an opportunity to make representations by 16 August 2019 as to why these claims should not be struck out, because they are a duplication of claims previously presented to the tribunal in case no. 2300225/2019, and hence an abuse of process.[2]The claimant has failed to make representations in writing by that date, or at all , as why this should not be done. These claims are therefore struck out.[3]The claimant’s remaining claims under case no. 2300225/2019 are unaffected by this judgment.
