JUDGMENT
The following Judgment is made against the first respondent under rule 21, the first respondent having declined to file a response form resisting the claims.[1]The claimant was dismissed in breach of contract relating to notice of termination, and the first respondent is ordered to pay the claimant the sum of £12,000.00 as compensation for that breach. This is a net sum but has been calculated by reference to gross pay because of the likelihood that the claimant will have to pay tax on this sum as “post employment notice pay”.[2]The claim in respect of payment for annual leave accrued but untaken is wellfounded, and the first respondent is ordered to pay the claimant the gross sum of £1,724.45.
