JUDGMENT

[1]The judgment of the Tribunal is that: After hearing a preliminary issue as follows: Whether the claim was presented outside the relevant time limits set out in the Employment Rights Act 1996 (ERA) [section 23(1)a – 23(2)a] and, if so, should it be dismissed on the basis that the Tribunal has no jurisdiction to hear it? The claim was presented outside the relevant time limits. The claimant was not able to show that it was not reasonably practicable to present the claim within the relevant time limits. The claimant’s claim for arrears of pay under section 13 ERA is therefore dismissed. The Tribunal has no jurisdiction to hear it. Employment Judge Wheat Date: 5 August 2021
