JUDGMENT
The complaints listed below are struck out under Rule 37 of the Employment Tribunal Rules of Procedure 2013 (“Rules”) on the grounds that they have no reasonable prospects of success.[1]All complaints against the second respondent.[2]The following complaints against the first respondent:-a. complaints of direct race/sex discrimination in a recruitment exercise in 2020.b. complaints of direct race/sex discrimination relating to the treatment of a black female patient by a former colleague of the claimant in 2022.c. the following complaints of harassment contrary to section 26 Equality Act 2010 (protected characteristic sex) i. a complaint that on 2 July 2022, unnamed employees of the first respondent were outside the claimant’s room. ii. a complaint that an employee of the second respondent contacted the claimant about ring bunders that she had not ordered. iii. A complaint that an administrative employee of the claimant contacted the claimant on a day off.REASONS
[1]The claimant was ordered to pay a deposit of £300 for each of 5 identified complaints following a preliminary hearing held on 14 November 2023. The Order was sent to the claimant on 19 March 2024..The claimant has failed to pay this deposit. The 5 complaints listed in the Annex below are therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.
