JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has made a series of unauthorised deductions from the claimant's wages and is ordered to pay the claimant the gross sum of £1,390.00 in respect of holiday pay and pay for days worked between 2 November 2020 and 8 January 2021.[2]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £475.00. This is a net sum but is based on the claimant’s gross pay because it is likely that the claimant will have to pay tax on this amount as Post Employment Notice Pay.[3]The respondent is also ordered to pay the claimant the net sum of £600.00 as compensation for financial loss in the form of interest and charges which the claimant has sustained as a consequence of the unauthorised deductions from pay.[4]The hearing listed on 30 June 2021 is cancelled.
