JUDGMENT

[1]The claimant’s complaint of constructive (unfair) dismissal was presented outside of the time limits at section 111 Employment Rights Act 1996. It was reasonably practicable for the complaint to have been presented in time. This complaint is dismissed.[2]The claimant’s complaint of breach of contract was presented outside of the time limits at article 7 of the Employment Tribunals Extension of Jurisdiction Order 1994. It was reasonably practicable for the complaint to have been presented in time. This complaint is dismissed[3]The claimant’s complaint of unauthorised deductions from pay is dismissed on the claimant’s withdrawal.

REASONS

[1]The claimant was ordered to pay 2 deposits of £500 each following a preliminary hearing held on 27 June 2022. The Order was sent to the claimant on 12 July 2022..The claimant has failed to pay this deposit. The deposit orders related to all outstanding complaints in this claim. The claim is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]The hearing fixed for 12 and 13 January 2023 will not take place.
