JUDGMENT

[1]The claim for constructive unfair dismissal was presented outside the applicable time limit under s.111 of the Employment Rights Act 1996 when it was reasonably practicable for it to have been presented in time. There is correspondingly no jurisdiction and the claim is dismissed.[2]The claim for whistleblowing detriment under the Employment Rights Act 1996 (ERA) was presented outside the time limit applicable under s.48(3) of the ERA when it was reasonably practicable for it to have been presented in time. There is correspondingly no jurisdiction and the claim is dismissed.[3]The complaints of discrimination and harassment were all of them presented outside of the applicable time limit specified in s.123(1)(a) of the Equality Act 2010 and it is not just and equitable to permit those complaints to proceed out of time.
