JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £4,679.28 subject to the usual statutory deductions.[2]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of £4,064.00 (calculated applying the statutory cap to weekly wages).[3]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £233.96 subject to the usual statutory deductions (entitlement rounded up to 2 days).[5]The respondent shall therefore pay to the claimant £8,977.24 subject as at paragraphs 1 and 3 above.[6]The hearing listed on 15th May 2019 is cancelled.
