JUDGMENT
[1]The claimant’s claims of unlawful deductions from wages contrary to Section 13(1) of the Employment Rights Act 1996 and non-payment of holiday pay contrary to Regulation 13 of the Working Time Regulation 1998 were presented out of time on the 22nd of January 2023. It was reasonably practicable for the claimant to bring her claim in time. The claimant did not do so. The Tribunal therefore has no jurisdiction to hear the claimant’s claims and they are struck out on this basis.[2]The claimant’s claims of direct and indirect discrimination on grounds of sex, and claims of harassment and victimisation, contrary to Sections 13, 19, 26 and 27 of the Equality Act 2010, were presented out of time on the 22nd of January 2023. They were also not presented within such other period as the Tribunal thought was just and equitable. The Tribunal therefore has no jurisdiction to hear the claimant’s claims and they are struck out on this basis. Judge Cowx 21 December 2023 Case No. 2401858/2023
