JUDGMENT

[1]The claimant’s claim of sex and/or disability discrimination are dismissed on withdrawal.[2]The claimant’s claim for unlawful deductions from wages in respect of statutory sick pay succeeds. The respondent must pay to the claimant the sum of £1,885.[3]The respondent breached the claimant’s contract of employment by failing to pay notice. The claimant’s claim for notice pay succeeds. The respondent must pay to the claimant twelve weeks’ pay in the sum of £2,304.60 (subject to deductions).[4]The claimant was unfairly dismissed by the respondent. Her claim of unfair dismissal succeeds. The respondent must pay to the claimant a basic award of £5,761.50. No compensatory award is awarded to the claimant. The recoupment provisions do not apply.[5]The respondent must pay the claimant £350.45 in respect of holiday pay which accrued but was unpaid. That is the net sum owed.
