JUDGMENT

The complaint of unfair dismissal is struck out.

REASONS

[1]By a letter dated 2 June 2020 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of unfair dismissal should not be struck out because the claimant lacks the necessary two years service to present a claim of unfair dismissal.[2]The claimant has failed to make representations in writing why this should not be done. The complaint of unfair dismissal is therefore struck out.[3]The claimant’s remaining claims remains listed for hearing on 2 September 2020. Employment Judge Holmes Date: 7 August 2020[1]The claim for statutory notice pay in the sum of £769.23 succeeds. It is agreed that the claimant is also entitled to £466.00 for fuel expenses.[2]The respondent is therefore ordered to pay the claimant £1,235.23 in total.[3]The remaining claim for unpaid wages fails and is dismissed.[4]The Employment Protection (Recoupment of Benefits) Regulations 1996 do not apply.
