JUDGMENT
[1]The complaint that the respondents directly discriminated against the claimant on the basis of his race is struck out.[2]The second respondent is dismissed from the proceedings.REASONS
[1]The claimant was ordered to pay a deposit of £250 by 14 July 2017 following a preliminary hearing held on 2 June 2017. The Order was sent to the claimant on 13 June 2017.The claimant has failed to pay this deposit. The complaint of direct race discrimination is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]The second respondent is dismissed from the proceedings as the remaining claims can only be brought against the first respondent.[3]The hearing scheduled to start on 15 January 2018 will continue although the length of the hearing may be reduced once the respondent’s response to the claimant’s amended claim has been received and considered.
