Employment Tribunals Rules of Procedure 2013 – Rule 21 The respondent , through its Administrators’ letter of 16 January 2017, having stated that it consents to these claims proceeding, and does not contest the claims IT IS THE JUDGMENT OF THE TRIBUNAL THAT:[1]The respondent failed to comply with the requirements of s.188 or s.188A of the Trade Union & labour Relations (Consolidation) Act 1992.[2]The claimant is entitled to a protective award. The protected period for the purposes of the award is 30 days from 7 December 2016 when the dismissal by reason of redundancy took effect, and the claimant is entitled to be paid remuneration in respect of this period.[3]The respondent is ordered to pay the said remuneration to the claimant, together with the tribunal fee of £250.00. 3. The hearing listed for 28 July 2017 is cancelled.
