JUDGMENT
[1]The claim as originally presented contained a complaint of direct race discrimination and thus no amendment of the claim to include such a complaint is required.[2]The claimant was a disabled person at the material time (March to July 2019) by reason of her condition of tinnitus within the meaning of section 6 of and Schedule 1 to the Equality Act 2010.[3]The claim was not presented within three months of the acts complained of and it was not presented within such other period as the Tribunal considers just and equitable within section 123(1)(a) and (b) of the Equality Act 2010.[4]Accordingly, the claim is dismissed and the final hearing dates in May 2023 are vacated.
