JUDGMENT
[1]The claimant’s employer and correct respondent is Carrs Billington Agriculture (Sales) Ltd.[2]All claims are dismissed against Carrs Group PLC, who no longer has any interest in these proceedings.[3]The claimant does not have sufficient continuity of employment to bring an unfair dismissal claim under section 94 of the Employment Rights Act 1996 as amended, a strike out warning was sent to the claimant on 21 February 1 of 2 Case Number: 2401213/2020 Code A 2020 and the claim for unfair dismissal is dismissed on the basis that under section 108 of the ERA the claimant is not entitled to bring a claim of unfair dismissal and none of the exceptions apply.
