JUDGMENT

The claimant’s claim is dismissed pursuant to rule 47 Employment Tribunal (Constitution and Rules of Procedure) Regulations 2013 by reason of the claimant’s non-attendance at the hearing.

REASONS

[1]The claimant failed to attend the hearing. His representative also failed to attend the hearing. Neither the claimant nor his representative communicated with the tribunal or the respondent to inform the tribunal that they would not be attending or to give any reason for non-attendance.[2]The claim was presented on 17 February 2024. The claims are unclear. The case was listed for a case management hearing in August. The claimant did not attend a neither did his representative but on that occasion but they wrote in advance to explain why they could not attend and sought a postponement which was granted.[3]Notice of this hearing was emailed to the parties on 20 August 2024 so the Case No: 2401134/2024 claimant is aware of this hearing.[4]The respondent has communicated with the claimant’s representative but received no response since August 2024.[5]Having taken the above circumstances into account and having had regard to rule 47 of the Employment Tribunal Rules of Procedure which permits me to strike out a claim for non- attendance, I have determined it is consistent with the overriding objective to dismiss the claim.
