Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £2,387.35 (which includes an uplift of 25% as the respondent unreasonably failed to comply with the ACAS code of practice on disciplinary and grievance procedures);[2]The claimant was unfairly dismissed. His claim is well-founded and succeeds;[3]As a result of the claimant’s unfair dismissal by the respondent, the claimant is entitled to a basic award of £1,614 and a compensatory award of £1,102.48. The latter award includes an uplift of 25% as the respondent unreasonably failed to comply with the ACAS code of practice on disciplinary and grievance procedures;[4]The prescribed amount is £381.98;[5]The prescribed period is 30 September 2020 to 31 October 2020;[6]The total amount awarded for both breach of contract and unfair dismissal is £5,103.83; and[7]The difference between the total amount of the awards and the prescribed amount, which should be paid to the claimant without delay, is £4,721.85.[8]The hearing listed for 27 July 2021 is cancelled.
