Employment Tribunals Procedure Rules 2024 – Rule 22[1]The respondent has failed to present a valid response on time, the interested party neither supports nor resists the claims, and a determination can properly be made of the claim in accordance with rule 22 of the Rules.[2]The claims seeking a protective award under section 189 Trade Union and Labour Relations (Consolidation) Act 1992 are well-founded. The respondent failed in its duty to consult the claimants under section 188 of that Act.[3]The respondent is ordered to pay to each claimant remuneration for the protected period of 90 days starting on 30 January 2025, the date the first dismissal took effect.[4]The recoupment regulations apply to the protective awards.
