JUDGMENT
The judgment of the Tribunal is that -(1) The claim for unlawful deduction from wages is well founded and the Tribunal orders the respondent to make payment to the claimant of £3,124 net (£3,624 net for September – November 2021 less £500 net paid).(2) The claim for breach of contract (notice pay) is well founded and the Tribunal orders the respondent to make payment to the claimant of £1,115.08 net (£278.77 net x 4 weeks).(3) The claim for payment for accrued but untaken holiday is well founded and the Tribunal orders the respondent to make payment to the claimant of £1,282.48 net (£55.76 net x 23 days).(4) The claim for unfair constructive dismissal is well founded and the Tribunal orders the respondent to make payment to the claimant of £1,728 (£1,228 basic award and £500 loss of statutory rights).(5) The total award to be paid by the respondent to the claimant is Seven Thousand Two Hundred and Forty-Nine Pounds and Fifty-Six Pence (£7, 249.56).(6) The claim for a statutory redundancy payment is not well-founded and does not succeed.(7) The Employment Protection (Recoupment of Benefits) Regulations 1996 do not apply.
