JUDGMENT
[1]The claimant’s application to amend her claim so as to rely on the impairments of fibromyalgia and/or chronic back pain in support of her contention to have been at the material time for the claim a disabled person within section 6 of the Equality Act 2010 is refused.[2]The claimant was not at the material time for her claim a disabled person within section 6 of the Equality Act 2010 by reason of the impairments of osteopenia and/or osteoporosis.[3]The claimant's complaint of unlawful disability discrimination within the Equality Act 2010 is accordingly dismissed. Case No. 2400801/2016 2[4]The claimant's remaining complaints of unlawful age discrimination within the Equality Act 2010 and unfair dismissal under the Employment Rights Act 1996 will proceed to hearing.
