JUDGMENT

[1]The claimant’s application to amend her claim so as to rely on the impairments of fibromyalgia and/or chronic back pain in support of her contention to have been at the material time for the claim a disabled person within section 6 of the Equality Act 2010 is refused.

[2]The claimant was not at the material time for her claim a disabled person within section 6 of the Equality Act 2010 by reason of the impairments of osteopenia and/or osteoporosis.

[3]The claimant's complaint of unlawful disability discrimination within the Equality Act 2010 is accordingly dismissed. Case No. 2400801/2016 2

[4]The claimant's remaining complaints of unlawful age discrimination within the Equality Act 2010 and unfair dismissal under the Employment Rights Act 1996 will proceed to hearing. Regional Employment Judge Robertson Date 24 April 2017
