The complaint of Unfair Dismissal is struck out.REASONS
[1]By a letter dated 3 May 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of Unfair Dismissal should not be struck out because -• it has no reasonable prospect of success. (as the claimant does not have the two years’ service required for such a claim)[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of Unfair Dismissal is therefore struck out.[3]The claimant’s remaining claims remain listed for a preliminary hearing on 14 September 2022. This is a case management hearing to discuss the issues in the claimant’s remaining claims and is not a final hearing of those claims. Employment Judge Feeney Date: 4 July 2022[1]The claimant’s claim of unauthorised deductions from wages is dismissed upon withdrawal by the claimant.[2]The Tribunal does not have jurisdiction to hear the claimant’s claim of race discrimination as it was presented outside the time limit set out in s.123 Equality Act 2010 and the Tribunal has declined to extend time under s129(2)(b). That claim is therefore also dismissed.[3]As the claimant has no other claims before the Tribunal, the proceedings are dismissed.
