JUDGMENT
[1]The correct respondent to the claim is Lano NW Ltd rather than Mohamad Ahmad Piewant and, the Tribunal being satisfied that both potential respondents were on notice of the claim, the title of the proceedings is amended accordingly.[2]The claimant’s complaints in respect of unpaid sick pay and unpaid holiday pay contrary to Part II of the Employment Rights Act 1996 are well-founded and the claim succeeds.[3]Taking into account sums already paid by the respondent to the claimant (as agreed by the claimant) the respondent is ordered to pay to the claimant the sum of £372.48 in respect of unpaid sick pay, the sum in question having been calculated in accordance with the claimant’s statutory entitlement to the national minimum wage.
