L Sargeant and others v Hotel Managers Ltd: 2400459/2025 and others
JUDGMENT
[1]The respondent has failed to present a valid response on time to each of these claims and a determination can properly be made of the claims in accordance with rule 22 of the Rules of Procedure.[2]The figures below are awarded in gross sums. The claimants should be aware that they may receive less than these amounts if the respondent accounts for statutory deductions before satisfying the awards. If the respondent pays the claimants the gross figures, then each claimant may need to satisfy any tax burdens individually from that award. L Sergeant[3]The respondent has made unauthorised deductions from the claimant’s wages and must pay the claimant £5,400.[4]The claimant was dismissed in breach of contract in respect of notice and the respondent must pay damages to the claimant of £1,800.[5]The respondent is ordered to pay the claimants a statutory redundancy payment of £1,246.14 (1 week’s pay for every complete year of service when the claimant was aged between 22 and 41= 1x3 x £415.38 = £1,246.14)[6]The unfair dismissal complaint is well-founded. The claimant was unfairly dismissed. No basic award is made because it has been extinguished by the redundancy payment.[7]The respondent has failed to pay the claimant’s holiday entitlement and must pay the claimant £600.[8]The respondent must pay the claimant £9,046.14 in total. D Hollingworth Carr[9]The respondent has made unauthorised deductions from the claimant’s wages and must pay the claimant £5,412.16.[10]The respondent has failed to pay the claimant’s holiday entitlement and must pay the claimant £2,733.77. T Kim[11]The respondent has made unauthorised deductions from the claimant’s wages and must pay the claimant £4,600. R Caton Jones[12]The respondent has made unauthorised deductions from the claimant’s wages and must pay the claimant £1,309.88.
