JUDGMENT
Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the Rules of Procedure.[2]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the net sum of £10,455.50 (£2770 for remaining wages in August + £4,360 for September wages + £2,420.25 for October wages + £905.25 for November wages). The respondent is also responsible for paying any tax deductible to HMRC.[3]The respondent is ordered to pay the sum of £1,614.00 (£415.00 for June + £217.00 for July + £281 for August + £286 for September + £294 for October + £121 for November) for petrol expenses.[4]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the net sum of £495.52 (statutory notice of 1 week at £495.52 per week).[5]The respondent is ordered to pay the claimant £500 for failure to provide a written statement of employment particulars.[6]The respondent must pay the claimant the total sum of £13.065.02 in total within fourteen days of this judgment.
