JUDGMENT
The complaint of Unfair Dismissal is struck out.REASONS
[1]By a letter dated 17/01/19 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of Unfair Dismissal should not be struck out because it has no reasonable prospect of success.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of Unfair Dismissal is therefore struck out.[3]The claimant’s remaining claims remains listed for hearing on 1 May 2019.[1]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the sum of £2,375.00, subject to such deductions as he is required to make for tax and national insurance.[2]The respondent breached the claimant’s contract by failing to repay petty cash expenses; the respondent is accordingly ordered to pay damages to the claimant in the sum of £200.00 (net).[3]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £800.00, subject to such deductions as he is required to make for tax and national insurance.[4]The hearing listed on 1 May 2019 is cancelled.
