JUDGMENT
[1]The complaints of unfair dismissal and breach of contract were not presented within the applicable time limit, but it was not reasonably practicable to do so. Both claims were presented within a further reasonable period and will therefore proceed.[2]The complaint of public interest disclosure (detriment) pursuant to section 47B of the Employment Rights Act 1996 is withdrawn and is dismissed.[3]By consent the complaint in respect of holiday pay is well-founded. The respondent made an unauthorised deduction from the claimant's wages by failing to pay the claimant for holidays accrued but not taken on the date the claimant’s employment ended.[4]The respondent shall pay the claimant £229.78. The claimant is responsible for paying any tax or National Insurance.[5]The remaining complaints will be considered at the final hearing, listed for 9 10 and 11 April 2025.
