Mr R D HariesClaimant1. Postworth Ltd T/a Sky Blue (In Compulsory Liquidation) 2. Carillion Plc (In Compulsory Liquidation)Respondent
Employment Judge FraneyDate 17 September 2024

JUDGMENT

The claim is struck out.

REASONS

[1]This case has been stayed since presentation in 2018 because the first respondent has been in compulsory liquidation. The stay cannot be lifted without permission from the High Court.[2]The claimant responded to a strike out warning by letter of 1 January 2024 making some representations, but did not seek a hearing.[3]After considering his representations, by a letter dated 30 January 2024 the Tribunal gave the claimant a final opportunity to pursue his claim by making an application to the High Court for permission to do. He was informed that if he had not done so by the end of April 2024 his claim might be struck out.[4]The claimant has not made such an application and it follows that his claim has not been actively pursued.[5]It is now struck out against both respondents and is at an end.
