JUDGMENT

[1]The claimants’ contracts of employment transferred from the first respondent to the second respondent on 18 November 2016.[2]Upon the transfer of liabilities from the first respondent to the second respondent, the second respondent became liable for and shall pay to each of the claimants the sums shown below in respect of unpaid wages and accrued holiday pay.[3]The second respondent shall pay the following awards: Ms Hartgen3.1 Wages in the sum of £696.60.3.2 Holiday pay in the sum of £64.60. Case Nos. 2400162/2017 2401779/2017 2401492/20173.3 Total: £761.20 subject to statutory deductions. Mrs Jones3.4 Outstanding wages of £638.00.3.5 Holiday pay of £120.00.3.6 Total: £758.00 subject to statutory deductions. Ms Martlew3.7 Outstanding wages £1,560 subject to statutory deductions.[4]The claimants have paid Tribunal fees and seek to recover them. As such fees have been adjudicated as unlawful it is not appropriate to make an order for the payment of a costs order in respect of them against either respondent; the claimants’ recoupment of fees is an administrative matter. The application for a Costs Order was refused.
