JUDGMENT
[1]The claim was presented in the Manchester Employment Tribunal on 4 January 2025. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 22 of the Rules of Procedure.[2]The claimant was dismissed in breach of contract in respect of notice and is entitled to notice pay.[3]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment.[4]The claim succeeds and the remedy to which the claimant is entitled will be determined at the hearing already listed at 2.15 pm on 6 June 2025. Approved by: Employment Judge Kenward 2 June 2025[1]The respondent shall pay the claimant £2,100.00 gross (6 x £350 gross weekly wage) as damages for breach of contract in respect of notice. This figure has been calculated using weekly gross pay to reflect the likelihood that the claimant will have to pay tax on it as Post Employment Notice Pay.[2]Under section 163 Employment Rights Act 1996 it is determined that the claimant is entitled to a redundancy payment of £2,100.00 gross (6 x £350).[3]Both notice pay and redundancy to be paid by the respondent to the claimant within 28 days of this Judgment.
