Mr L Gheorghe v ASD Transport Ltd T/a ASD Coaches: 2313071/2024
JUDGMENT
The claims are is struck out on the grounds that they have not been actively pursued.REASONS
[1]The claimant complains of unfair dismissal (although he appears to be still employed by the respondent), race discrimination, disability discrimination, money claims and a claim for whistleblowing (protected disclosure).[2]On 26 March 2025 Judge Heath ordered the claimant to provide further details of his claims within 21 days. The claimant failed to comply with that order.[3]On 24 June 2025 the respondent applied to strike the claim out.[4]On 6 September 2025 Judge Hart warned the claimant that she was considering striking out the claim because the order of 26 March 2025 had not been complied with, and on the grounds that the claim was not being actively pursued. The claimant was ordered to respond within 14 days if he objected to the proposal to strike out the claim.[5]No response has been received from the claimant.[6]It appears that the claim is not being actively pursued. In the absence of any contact from the claimant, the claim is struck out under rule 38(1) (d) of the Employment Tribunal Rules of Procedure 2024.[7]The hearings listed for 17 February 2026 and 22-26 February 2027 will be cancelled.
