JUDGMENT
[1]The Respondent’s application for reconsideration of the decision to reject the Response he presented out of time was unsuccessful. It is not in the interests of justice to reconsider that decision.[2]Each of the Claimant’s complaints that: a) She was underpaid the amount payable to her by way of statutory redundancy payment; b) She was wrongfully dismissed (i.e., that there was an underpayment to her of the notice pay to which she was entitled); and c) The Respondent failed to provide her with a statement of written employment particulars, succeeds.[3]The Claimant also complained that the Respondent failed to comply with its automatic enrolment obligations in respect of the period of her employment which 1 of 2 Case Number: 2309164/2025 began on 31 October 2018 and 1 January 2022, in breach of the Pensions Act 2008. That complaint is outside of the Tribunal’s jurisdiction to determine.[4]The Respondent is Ordered to pay to the Claimant: a) £6,775.50, by way of underpayment of statutory redundancy payment; b) £1,238.23, by way of underpayment of notice pay; and c) £1,303.40 as compensation for failure to provide her with written particulars of employment.[5]The Claimant must account to HMRC for any income tax or employee’s National Insurance contributions she owes in respect of any sums paid to her pursuant to this judgment.
