Employment Tribunals Rules of Procedure 2013 – Rule 21[1]No response having been entered by the respondent, the claim of unfair dismissal succeeds.[2]The remedy to which the claimant is entitled will be determined at the Hearing already listed for 26 August 2021. The respondent shall be permitted to participate in that Hearing only at the discretion of the Judge.[3]The claimant shall send to the Tribunal (2 copies) and the respondent (1 copy) no later than 2 March 2021 a statement setting out the remedy he seeks including a calculation of any sums he claims and details of efforts he has made to mitigate his loss. For the purposes of regulation 4 of the Employment Protection (Recoupment of Benefits) Regulations 1996 (SI 1996/2349): The Prescribed Element is: £13,024; The Prescribed Period is: 30 October 2020 to 02 April 2021; The total monetary award is: £35,170.25; The excess of the total monetary award over the Prescribed Element is: £22,146.25.
