JUDGMENT
[1]For the reasons given orally on 29 September 2021, the Claimant’s claim for unfair dismissal is well founded and succeeds.[2]For the reasons given orally on 29 September 2021, the Claimant’s claim for notice pay is well founded and succeeds.[3]The Respondent will pay the Claimant: a) A Basic Award of £4075.50 (Calculated on 19 complete years’ service (one of which the Claimant was aged over 41) leads to a multiplier of 19.5 x £209.00 = £4,075.50); b) A Compensatory Award of £2,276.50 (Calculated as 8.5 weeks’ full pay at £209.00 per week is £1,776.50, plus loss of statutory rights (long service) of £500.00)[4]The damages for the notice pay claim would be £1,776.50 (calculated as 8.5 weeks at £209.00 per week). However, this period of loss is already compensated by the loss of income element under the Compensatory Award and shall not be paid twice by the Respondent. In the event that the Claimant is unable to recover the Compensatory Award from the Respondent in the liquidation, she can apply to recover damages for notice pay and the Basic Award from the National Insurance Fund.
