JUDGMENT
The claim is struck out under Rule 37(1)(d).REASONS
[1]By a letter dated 11 October 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because of non-compliance with an Order of the Tribunal.[2]By a letter dated 14 October 2022 the Tribunal invited comments from the respondent as to whether the claimant had engaged in preparations for the Final Hearing (at that point listed to begin on 17 October 2022). The respondent responded on the same day to confirm that he had not.[3]By a further letter dated 14 October 2022 the Tribunal indicated that the claim would be struck out for a failure to actively pursue it. Although the claimant sent an email later that day asking for consideration of what he planned to say in a separate email, no separate email has been received, nor has any correspondence been received from the claimant since 14 October 2022.[4]In view of the above, it remains appropriate to strike-out the claim for a failure on the part of the claimant to actively pursue it.
