The response is struck out.

REASONS

[1]By a letter dated 22 October 2021 the Tribunal gave the respondent an opportunity to make representations or to request a hearing, as to why the response should not be struck out because the respondent has not complied with the Order of the Tribunal dated 28 September 2021.[2]No response has been received from the respondent.[1]This matter was listed for two day final hearing to take place starting today, 14th November 2023.[2]There had been a preliminary hearing on this matter on 30 April 2023 which the claimant’s representative had attended, at least in part. At that hearing the Employment Judge made a number of case management orders which were sent to the parties. This provided that the claimant needed to take a number of steps. 3.It appeared that none of the steps had been carried out. No paperwork had been sent to the employment tribunal. Neither party attended at this morning’s hearing. The clerk was asked to make enquiries. 4.On being contacted the claimant’s representative confirmed that the claimant was not attending as he had gone to work. He was no longer interested in pursuing this case. 5.As the claimant has not taken any steps to prepare his case, has not complied with any tribunal orders, has not attended and has indicated he does not wish to pursue the case, I am striking it out under rule 37(d) because it has not been actively pursued. 14 November 2023
