The complaint of unfair dismissal is struck out.

REASONS

[1]By a letter dated 26 March 2024 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of unfair dismissal should not be struck out because the claimant does not appear to be entitled to bring such a claim (per section 108 Employment Rights Act 1996), and it therefore has no reasonable prospects of success.[2]The claimant has failed to make representations in writing why this should not be done or to request a hearing. The complaint of unfair dismissal is therefore struck out.[3]The claimant’s remaining claim(s) remain listed for a preliminary hearing on 11 December 2024, and a final hearing on 22-25 September 2025.
