Under the provisions of Rule 67 the Judgment dated 9 January 2025 is corrected by inserting the correct case number as set out in bold type above Rule 38(1)(d) Employment Tribunal Rules of Procedure 2024 The claim is struck out because it has not been actively pursued.REASONS
[1]The respondent’s solicitors advised in December 2021 that the respondent was going into administration.[2]No steps have been taken since then to pursue the claim.[3]The Tribunal notified the parties on 22 November 2024 to that it was considering striking out the claim because it had not been actively pursued.[4]The claimant has responded to say that she understood there was no point in pursuing the case further.[5]That appears to be the case and so there is no reason to leave open the possibility of a successful claim.
