JUDGMENT

[1]The complaint of constructive unfair dismissal is well-founded. The claimant was unfairly dismissed.[2]The respondent shall pay the claimant the following sums in respect of her successful unfair dismissal complaint:(a) A basic award of £853.86.(b) A compensatory award of £853.86. Note that these are actual the sums payable to the claimant after any deductions or uplifts have been applied.[3]The Employment Protection (Recoupment of Benefits) Regulations 1996 apply to the unfair dismissal claim: Page 1 of 3a. The total monetary award (i.e. the compensatory award plus basic award) payable to the claimant for unfair dismissal is £1707.72.b. The prescribed element is £853.86.c. The period of the prescribed element is from 6 October to 17 November 2023.d. The difference between (a) and (b) is £853.86.[4]The complaint of unauthorised deductions from wages is well-founded, the respondent having conceded this claim during the course of the Hearing. The respondent made an unauthorised deduction from the claimant's wages in the amount of £586.31.[5]The respondent shall pay the claimant £586.31, which is the gross sum deducted. The claimant is responsible for the payment of any tax or National Insurance.[6]The complaint of direct sex discrimination is dismissed following its withdrawal by the claimant on 23 July 2025 (during the Hearing).
