JUDGMENT

[1]The claim for Direct Disability Discrimination section 13 Equality Act 2010 in relation to the application for a Superintendent Role is dismissed upon withdrawal by the claimant[2]The claimants claims under section 15 Equality Act 2020 are well founded and succeed.[3]The claimants claims under section 20 & 21 of Equality Act 2010 for reasonable adjustments to i. Alter the attendance and Mandatory training criteria from the ERTW scheme is well made out and succeeds ii. Allow Claimant to rescind the retirement Application and find a suitable alternative role is well made out and succeeds iii. Disapply the Attendance and Mandatory Training Criteria from the ERTW scheme is not well founded and is dismissed iv. Allow to rescind the retirement application and retain him in his role is not well founded and is dismissed[4]The claimants claim for Indirect Disability Discrimination under section 19 Equality Act 2010 are not well founded and is dismissed[5]The claimants claim for Harassment related to Disability under section 26 Equality Act 2010 are not well founded and are dismissed[6]The claimants claim for Direct Disability Discrimination under section 13 Equality Act 2025 is not well founded and is dismissed Approved by:
