JUDGMENT
[1]It is declared that the second claimant (Mrs Santhakala Jegatheeswaren) was an employee of the respondent within the meaning of section 230 of the Employment Rights Act 1996.[2]By consent, the respondent is ordered to pay the second claimant the sum of £83.36 for one day’s pay, subject to the respondent receiving her bank account details so as to make the money transfer.[3]By consent, the respondent is ordered to pay the first claimant the following sums, subject to the respondent receiving his bank account details so as to make the money transfer:a. Notice pay in the sum of £514.00 subject to tax;b. Eight day’s pay in the sum of £890.00 subject to tax;c. Holiday pay in the sum of £95.00 subject to tax.[4]The claims of “ordinary” unfair dismissal are dismissed because the claimants did not have the requisite 2 years employment service.
