The Claimant’s claims are struck out.REASONS
[1]On 27th August 2024, I made specific Orders in my Case management Order and the Claimant has failed to comply with them.[2]Employment Judge Lumby issued the Claimant with a strike-out warning because she failed to comply with my Order did not appear to be actively pursuing her claim.[3]The Claimant has failed to comply with the my above mentioned Order nor responded to Employment Judge Lumby’s strike-out warning.[4]Therefore, the Claimant’s claims are struck out under Rule 38(1)(c) and (d) of The Employment Tribunals Rules of Procedure 2024 because the Claimant has:(i) Failed to comply with an instruction or Order of the Tribunal; and(ii) Is not actively pursuing her claim.[5]The Final Hearing listed for 3rd to 6th June 2025 is vacated.
