JUDGMENT

[1]The Respondent’s application for a strike out of the Claimant’s claim of disability discrimination, on the basis that the claim is out of time, is refused. The claim was not presented within the applicable time limit, but it is just and equitable to extend the time limit. The claim will therefore proceed.[2]The Respondent’s application under rule 37(1)(a) for a strike out of the Claimant’s claim of disability discrimination on the basis that the claim has no reasonable prospect of success is refused. The claim will therefore proceed.[3]The Respondent’s application under rule 39 for a deposit order in respect of the Claimant’s claim of disability discrimination on the basis that it has little reasonable prospect of success is refused.
