The Claimant has failed to pay this deposit. The complaint that the Claimant was directly discriminated against by reason of disability, by the Respondent not paying him in lieu of accrued holiday upon return from long-term sickness absence is therefore struck out under rule 40(4) of the Employment Tribunal Procedure Rules 2024.
