JUDGMENT
[1]The name of the respondent is amended to “Simyra Limited (in voluntary liquidation)”.[2]The Secretary of State for Business, Energy and Industrial Strategy is removed as a respondent as they appear to have been wrongly included.[3]The complaint of unauthorised deductions from wages is well-founded. The respondent made unauthorised deductions from the claimant's wages in the period from 1 March 2024 to 5 April 2024 in respect of 10.75 days which the claimant worked but was not paid for.[4]The respondent shall pay the claimant £4548.07, which is the gross sum deducted. The claimant is responsible for the payment of any tax or National Insurance.[5]The complaint of breach of contract in relation to notice pay is well-founded.[6]The respondent shall pay the claimant £9166.66 as damages for breach of contract. The claimant had a one month notice period. This figure has been calculated using gross pay to reflect the likelihood that the claimant will have to pay tax on it as Post Employment Notice Pay. Case Number: 2305780/2024[7]The complaint in respect of holiday pay is well-founded. The respondent made an unauthorised deduction from the claimant's wages by failing to pay the claimant for 7 days holiday which had accrued but not been taken on the date the claimant’s employment ended.[8]The respondent shall pay the claimant £2961.53.
