JUDGMENT
[1]The complaint in respect of holiday pay is well-founded. The respondent made an unauthorised deduction from the claimant's wages by failing to pay the claimant for holidays accrued but not taken on the date the claimant’s employment ended.[2]The respondent shall pay the claimant £436.15 in respect of accrued but untaken holiday. The claimant is responsible for paying any tax or National Insurance.[3]The complaint of breach of contract is well-founded. The respondent was in breach of contract in failing to pay the claimant the amounts showing on his wage slips and which were due to him in the months of July and August 2022.[4]The respondent shall pay the claimant £912.37 as damages for breach of contract.
