[1]This claim was listed for an open preliminary hearing today.[2]By consent, the name of the respondent is amended to ABM Facility Services UK Limited.[3]The claimant’s application to amend his claim to add a claim for breach of contract is refused. The Tribunal does not have jurisdiction to hear such a claim as the claim did not arise at the effective date of termination.[4]The respondent’s application to strike out the claimant’s claim for unfair dismissal is refused.[5]The respondent’s application for a deposit order is refused.[6]The Case Management Orders sent to the parties have previously been varied by agreement and are as follows:a. 12 August 2022 – disclosure of documents.b. 19 August 2022 – agree hearing bundle and send it to claimant shortly thereafter.c. 16 September 2022 – service of witness statements.d. 14 October 2022 – Final hearing – 1 day. 10.2 Judgment - rule 61 February Case No: 2305696/2021[7]Additionally, the respondent is to provide a List of Issues by 19 August 2022.
