JUDGMENT

[1]The complaint of discrimination arising from disability, in relation to not being offered further shifts from around 4th August 2021 because of the Claimant’s email sent on 24th July 20211, is dismissed upon withdrawal.[2]It is just and equitable to extend time in relation to the remaining complaint of discrimination arising from disability in relation to having his Occupational Health appointment cancelled2.[1]Found at Paragraph 61.1 of the Case Management Orders dated 6th March 2023 in respect of a hearing on 18th January 2023.[2]Found at Paragraph 61.2, ibid. REASONS

[1]On the application for a strike out by the Respondent dated 06 October 2023 and the response by the Claimant dated 07 October 2023: The Respondent’s application is successful. The claim has no reasonable prospect of success. Claimant’s application to amend is refused, the balance of prejudice is in the respondent’s favour.[2]The claim is therefore struck out.
